DMCA Copyright Policy

17 U.S.C. § 512 Safe Harbor Agent: DMCA-1071295 Effective 2018

1. Platform Overview

TierMaker allows users to create and share "tier list" templates — collage-style ranking tools used for opinion, commentary, and satire. Users independently upload all images. TierMaker acts solely as a passive hosting intermediary with no editorial control over user-submitted content.

Images are displayed in small thumbnail format as part of multi-image assemblages (typically 10–1,000+ images per template), consistent with commentary and transformative use.

2. Designated DMCA Agent

Pursuant to 17 U.S.C. § 512(c)(2), our designated agent for copyright infringement notices is:

3. Filing a Takedown Notice

To submit a valid notice under 17 U.S.C. § 512(c)(3), email [email protected] with all of the following:

Identification of the copyrighted work — describe the specific work claimed as infringed, including any copyright registration number.

Identification of the infringing material — provide the specific TierMaker URL(s) where the material appears.

Your contact information — full legal name, email address, mailing address, and phone number.

Good faith belief statement — a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.

Accuracy statement — a statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Signature — your physical or electronic signature.
17 U.S.C. § 512(f) Warning: Any person who knowingly and materially misrepresents that material is infringing may be liable for damages, costs, and attorneys' fees. Notices that are materially incomplete will not trigger our takedown obligations.

4. Our Response

Upon receipt of a complete, valid notice, TierMaker will promptly remove or disable access to the identified material, notify the uploading user, and document our action. Removal does not constitute an admission that any infringement occurred.

5. Counter-Notice

If you believe your content was removed by mistake, you may submit a counter-notice under 17 U.S.C. § 512(g) to [email protected]. A valid counter-notice must include:

Identification of the removed material and its location on TierMaker prior to removal.

Good faith belief statement — under penalty of perjury, that the material was removed by mistake or misidentification.

Consent to jurisdiction — consent to federal district court jurisdiction in your district (or any district where TierMaker may be found, if outside the U.S.).

Your contact information — full legal name, email, mailing address, and phone number.

Signature — your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. Absent a court order, we may restore the material within 10–14 business days at our discretion.

6. Repeat Infringer Policy

Per 17 U.S.C. § 512(i), TierMaker maintains a policy to terminate, in appropriate circumstances, users who are repeat infringers. Users with multiple substantiated infringement notices may have their accounts suspended or permanently terminated without prior notice.

7. Safe Harbor & Fair Use

TierMaker qualifies for safe harbor protection under 17 U.S.C. § 512(c). We do not have actual knowledge of infringing material, do not receive a direct financial benefit attributable to specific infringements, and respond expeditiously to valid takedown notices.

Some user content may qualify as fair use under 17 U.S.C. § 107 — including commentary, criticism, parody, and satire. TierMaker takes no position on fair use claims on behalf of its users. Users who believe their content qualifies as fair use are encouraged to consult legal counsel.

8. Policy Updates

TierMaker reserves the right to modify this policy at any time. Updates will be posted on this page with a revised effective date. Continued use of TierMaker constitutes acceptance of any updated policy.
